On Behalf of | Mar 21, 2017 | Probate and Estate Administration | 0 comments

Probate is something that many Pittsburgh residents are loath to consider because it is an acknowledgement of the inevitable end to their lives. However, this is something that is an integral part of taking care of loved ones after they have passes and should not be ignored. After a person has died, it can also be an issue. Those who have been designated as the executor in a will need to know that probate and probate litigation is something that arises frequently and it is preferable to take steps to have everything organized when planning.

Being a will executor is an important responsibility that takes place in Orphans’ Court after a loved one has died. Having legal representation for this process can make things much easier. The executors and administrators of an estate can have a difficult time grasping the concepts of probate litigation. This is when it is imperative to have legal assistance. There are a great many tasks that must be completed during probate including making collections on the estate’s assets, paying debts that the testator owed, paying taxes, gathering legal documents and completing them as needed, and being responsible for distribution of assets and property to heirs.

In addition, it is even more important to have legal help when there is a contested will or no will. It is unfortunate that this happens, but when it does, having an attorney who knows the ins and outs of the probate laws can make all the difference. It might be that there are allegations of abuse at the hands of an executor or administrator. Manipulation might have taken place. The assets could be in dispute. For these issues and more, probate litigation is a necessity.

In the best case, there will be a smooth process of probate with no disagreements and the family choosing to move on after the death of a loved one with everyone satisfied. In others, there are disputes. Regardless of the situation, having legal assistance with probate of a will is imperative and the first call that should be made when planning or functioning as an executor.
